Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (GTC) govern all sales of products and services offered by Lizards (hereinafter "Lizards") to its customers, via the website www.lizards.ch, by email, by phone, or at the showroom.

Any order for products or services implies full and complete acceptance of these GTC, which take precedence over any other customer document, unless otherwise agreed in writing by Lizards.

2. Products and Services

Lizards specializes in the sale and installation of bioethanol fireplaces, electric and water vapor fireplaces, gas garden fireplaces, as well as complementary products (fuel, fire pits, fans, decorations, etc.).

Lizards also offers associated services: project studies, technical visits, personalized advice, installation, commissioning, user training, after-sales service, and maintenance contracts.

The essential characteristics of the products and services are described on the website or in personalized offers and quotes. Photos and illustrations are indicative and do not constitute a contractual commitment.

3. Prices

Prices for products and services are indicated in Swiss Francs (CHF), either VAT included or VAT excluded, depending on the presentation.

For certain highly configurable products or custom projects, prices are not indicated online and are subject to a personalized offer after assessing the client's situation (dimensions, integration, options, technical constraints, etc.).

Lizards reserves the right to modify its prices at any time, but products and services are invoiced based on the rates in effect at the time of order confirmation or accepted quote.

4. Order

An order is considered firm and final when:

the client has validated their order online, or

the client has returned a signed quote or given their written agreement (email) to Lizards' offer.

Lizards reserves the right to refuse or cancel any order from a client with whom there is a dispute relating to a previous order or a clear solvency issue.

For projects involving installation, a plan or technical visit may be necessary before final order validation.

5. Payment

Payment terms (down payment, balance, deadlines) are specified on the quote, invoice, or during online ordering.

Unless otherwise stated, a down payment may be required upon order, with the balance due upon delivery or at the completion of installation.

Payments can be made by the methods accepted and indicated by Lizards (bank transfer, cards, others). In case of late payment, Lizards reserves the right to charge late payment interest and, if applicable, to suspend ongoing services until the situation is settled.

6. Delivery and Installation

Delivery conditions (times, costs, location) are specified during the order or quote process. Communicated delivery times are indicative; any reasonable delay does not entitle to compensation, unless a specific written commitment has been made.

When the project includes installation, it is carried out by Lizards or by mandated partners, according to industry standards and manufacturer recommendations. Specific conditions for site access, site preparation, or preliminary work (electrical, masonry, carpentry, etc.) must be precisely defined with the client.

Lizards cannot be held responsible for delays or installation impossibilities related to incomplete or erroneous information provided by the client, or to the lack of necessary preparatory work.

7. Warranty

Legal Warranty
Lizards applies the legal warranty provided by Swiss law, covering material defects of delivered products.

Commercial Warranty
Unless otherwise stated, all products sold by Lizards benefit from a 2-year warranty from the date of delivery or installation, covering manufacturing defects under normal conditions of use.

The warranty does not cover:

normal wear and tear,

deterioration due to improper use, lack of maintenance, or unauthorized modifications,

damage related to work carried out by unauthorized third parties.

The terms of warranty application (repair, replacement, refund) are specified on a case-by-case basis, depending on the product concerned and the assessment made by Lizards.

8. After-Sales Service and Maintenance Contracts

Lizards provides after-sales service for the products it has sold and/or installed:

diagnosis,

on-site interventions when necessary,

ordering of spare parts,

advice on use and maintenance.

Lizards also offers the option to subscribe to a maintenance contract, allowing for periodic monitoring of installations (checks, adjustments, preventive maintenance). The conditions, included services, and rates for these contracts are specified in dedicated documentation or a specific quote.

9. Liability

Lizards makes every effort to ensure the quality of its products and services. However, its liability can only be engaged within the limits provided by law and these GTC.

Lizards cannot be held responsible for:

damage resulting from improper use of the products,

non-compliance with safety and maintenance instructions communicated to the client,

consequences of modifications or interventions carried out by unauthorized third parties,

indirect damages (loss of enjoyment, loss of profit, etc.).

In any event, Lizards' liability, when engaged, is limited to the amount of the order concerned.

10. Personal Data

In the course of its activities, Lizards collects and processes certain personal data from its clients (contact details, contact information, project-related data).

This data is used solely for order management, communication with the client, installation monitoring, and, if the client has consented, for sending information or newsletters.

Lizards commits to processing personal data in accordance with current legislation and not to transmit it to third parties not involved in the performance of services, except for legal obligations. The client may at any time request access, rectification, or deletion of their data, within the limits provided by law.

11. Intellectual Property

All content on the website www.lizards.ch (texts, images, logos, graphic elements, site structure, etc.) is protected by intellectual property rights and remains the exclusive property of Lizards or its partners.

Any reproduction, distribution, or use of this content, even partial, without prior written authorization, is prohibited.

12. Applicable Law and Jurisdiction

These GTC are governed by Swiss law.

In case of dispute, the parties will endeavor to find an amicable solution. Failing that, the competent courts will be those of Lizards' registered office, subject to mandatory legal provisions.
